General questions

The Limitation Act, 1963 prescribes specific periods for different types of civil suits — generally between three and twelve years depending on the nature of the claim. Suits filed beyond the limitation period are liable to be dismissed as time-barred, making timely action essential.

An injunction is a court order restraining a party from doing a particular act (prohibitory injunction) or directing a party to do a particular act (mandatory injunction). Temporary injunctions may be sought at the interim stage; permanent injunctions are granted after trial of the suit.

A title search is a review of property documents over a specified number of years to verify the chain of ownership, identify encumbrances, and assess marketability of title. It is typically undertaken by banks before sanctioning loans and by purchasers before acquiring immovable property.

Order XXXVII of the Code of Civil Procedure, 1908 provides a summary procedure for recovery of debts evidenced by negotiable instruments or written contracts. The defendant must seek leave of the court to defend, making it a faster route to recovery for creditors with documentary evidence.

A suit for mesne profits seeks compensation for the period during which the plaintiff was wrongfully dispossessed of their property by the defendant. It is typically filed alongside or after an eviction suit and compensates the plaintiff for the loss of use and occupation of the property.
