Motor Accident Claims & Personal Injury

Representation in Motor Accident Compensation Proceedings before Tribunals, the Delhi High Court, and the Supreme Court of India

Motor accident compensation proceedings in India are governed by the Motor Vehicles Act, 1988, which provides for structured adjudication of claims before designated Motor Accident Claims Tribunals (MACTs). The firm has handled a significant number of such matters, representing claimants as well as insurance companies and vehicle owners as respondents.

The firm's practice in this area spans the entire appellate chain — from original MACT petitions at the Tribunal level, to MACT Appeals before the Delhi High Court, and Special Leave Petitions before the Supreme Court of India. The firm advises on compensation computation, settlement options, and procedural strategy in each matter.

The firm's advocates are conversant with the evolving jurisprudence of the Supreme Court on the multiplier method and structured compensation.

Kye features

The firm represents claimants — injured persons, their dependants, and the families of deceased victims — as well as respondents including insurance companies and vehicle owners, in MACT proceedings. This dual-side experience gives the firm a well-rounded understanding of the legal issues at stake.

Compensation in MACT matters is governed by principles established through a line of Supreme Court decisions. Relevant factors include the age, income, and occupation of the deceased or injured, the degree of permanent disability, treatment and rehabilitation expenses, and the applicable multiplier under the structured formula.

General questions

A MACT is a statutory forum established under the Motor Vehicles Act, 1988. It adjudicates claims for compensation arising from motor accidents involving death or bodily injury. Jurisdiction is determined by the location of the accident, the residence of the claimant, or the registration of the vehicle involved.

Persons who have suffered injury in a motor accident, or the legal heirs and dependants of persons who have died in such an accident, may file a claim for compensation before the appropriate Tribunal.

Compensation is calculated based on principles established by the Supreme Court of India. Relevant factors include the age and income of the deceased or injured person, the degree of disability caused, out-of-pocket expenses, loss of future earnings, and the applicable multiplier.

Yes. An award passed by a MACT may be challenged before the Delhi High Court by way of a MACT Appeal. The High Court's decision may then be challenged before the Supreme Court of India through a Special Leave Petition under Article 136 of the Constitution.

Under the Motor Vehicles Act, 1988, a claim must ordinarily be filed within six months of the date of the accident. However, courts have discretion to condone delay in appropriate circumstances. It is advisable to file the claim as soon as possible after the accident.
