General questions

A consumer is defined under the Act as a person who purchases goods or avails of services for personal use — not for commercial resale or use in the course of business. A person who avails of services for commercial purposes does not qualify as a consumer under the Act.

Jurisdiction depends on the pecuniary value of the claim. District Consumer Commissions handle claims up to ₹50 lakh; State Consumer Disputes Redressal Commissions handle claims up to ₹2 crore; and the NCDRC has jurisdiction over claims exceeding ₹2 crore. Appellate jurisdiction flows upward accordingly.

Deficiency of service is defined under the Consumer Protection Act, 2019 as any fault, imperfection, shortcoming, or inadequacy in the quality, nature, or manner of performance of a service. Establishing deficiency of service is the foundation of most consumer complaints.

A Consumer Commission may direct payment of compensation, replacement or repair of goods, refund of price, removal of deficiency, discontinuance of unfair trade practice, and payment of costs. In cases of gross negligence, it may also award punitive damages.

Under the Consumer Protection Act, 2019, a complaint must ordinarily be filed within two years from the date on which the cause of action arose. The Commission has discretion to condone delay if sufficient cause is shown.
